Our customer, Paul Nunn and his family think MeMaw's is 'better than good'.
Paul won last years (2013) Florida Gulf Coast Open Chili Cook off using our
MeMaw's Chili Powder. That qualified him to attend the ICS* World Finals in
Palm Springs, CA last October where he got 2nd place and $2500.  This year
his family swept 1st, 2nd and 3rd at the Florida Gulf Coast Open (all using 
MeMaw's Chili Powder) and he is again headed to the World Finals in Las 
Vegas at the MGM Grand Oct. 25-26 this year.
We are wishing him the best to bring home the Grand Prize this year-a check for
$25,000 and "the big Trophy". Paul uses ONLY MeMaw's Chili Powder along

TX for buying what they thought was Gebhardt's

ante to get this dispute resolved once and for all.
Mild Bill's claims they have the Gebhardt Chili 
Powder in bulk-I say it does not exist.  
The first person over the age of 18:

(1) that brings to me the ConAgra UPC # from a 
bulk Container (25 or 50 lb) of Gebhardt Chili 
Powder 
(2) at Mild Bill's Spice Co., Ennis, TX
(3) once verified by ConAgra Foods to be a true 
and legitimate
assigned UPC #, 
(4) will be issued a Cashiers Check in the amount 
of $5000.00.

Barrack Obama and Mild Bill's Spice Co.

Last month the Washington Post awarded President Barrack
Obama the prestigious "Liar of the Year" award with 3 Pinocchio's.
We are sorry that they did not investigate Mild Bill's Spice Co. as it
would have at least been a tie. Obama's lies will affect millions
whereas Mild Bill's lies will affect hundreds, possibly thousands. 

What lies have Mild Bill's told in 2013 that would make them a candidate?

1) "Mild Bill's has not and will not deceive any one
     by selling a false or misrepresented product."


2) "
While we no longer carry Gebhardts in the 5 lb 
    containers, we still sell it in bulk."

3) "We carry Gebhardts in bulk and repackage it in 
     different quantities."

4)
"we are still able to meet the minimum requirements to buy from
      Conagra foods so we are able to offer to you Gebhardt Chili 
      Powder in any size you want."

5) "They [Mild Bill's] bought ALL remaining inventory from Conagra
      when the bulk was discontinued in late 2011."

      faux Gebhardt Chili Powder, but actual Gebhardts that they purchased
      in bulk, direct from Conagra Foods, the parent co. of Gebhardt's."

      Bill's as well as San Antonio Original (Gebhardts in our package
      with our label)."

8) Mild Bill's Spice Co. gets BONUS points for lying to 
     an Ennis lawyer and has him write us a nasty threat letter.

Mild Bill's Spice Co. is located in Ennis, TX. They are an Internet
based spice business and a major sponsor in the CASI (Chili Appreciation
Society International) organization. CASI is one of two major chili
organizations that promote chili cook offs in the United States. Our
initial complaint to CASI that Mild Bill's was selling a faux chili powder
advertised as Gebhardt's was not responded to or even investigated.
They did not want to get involved even though it would affect possibly
thousands of their members as Gebhardt's is a 'heavily used' product
by 'chili heads'.  Previous Championship recipes are posted on both
organizations web sites and Gebhardt's Chili Powder is repeatedly
listed
as a main ingredient. With good reason. It has been around 117 years
and unlike most chili powders on the market today does not contain
ANY salt or msg.  For a spice company, especially in Texas, to sell an
inferior product advertised as Gebhardt's is not only deceptive, it is 
just plain wrong to LIE to your customers.  This ranks right up there
with horse stealing, which used to be punishable by public hanging.

Chili cook off participants, even though looked to as a 'hobby', take
it quite seriously.  To not place when you know you have a winning
recipe, due to a greedy company selling you an inferior product, is
just wrong. Are times that tough?

Update Friday  12/20/2013

Well Gee-Has anyone besides TexMex.net noticed that BOTH
companies previously advertising they could sell you Gebhardt
Chili Powder from a BULK container no longer have this posted
on their web sites to sell?  Here are some screen shots to show that
fact...........Remember, you have read it here since July of 2013 that
they both had been selling an inferior product since at least July 
of 2012.  A lot of chili and tamale makers have been duped.  I know 
I would be pissed to say the least. And then when exposed in July of this
year they BOTH continued to say they had Gebhardt Chili Powder
in bulk form.........Are times that tough you have to LIE to your
customers? Like we have stated since July of 2013-the ONLY size
of Gebhardt Chili Powder available is the 3 oz bottle !!  Period.

And yet another email from a customer of ours this week:

"By the way.  I tried your competitor's [Mild Bill's] "Gebharts" bulk chili 
powder and there is no comparison.  Now we have 80 dozen tamales with 
substandard flavor made with their chili powder that we may have to discard."
(Customer bought our MeMaw's, then tried Mild Bill's supposed BULK Gebhardt
then came back to us for 50 lbs of MeMaw's)

Don't Take Our Word-Call someone that KNOWS they were duped
Yet another call recently from a disgruntled gentleman in Austin, TX that
bought a 'supposed' 5 lb container of Gebhardt Chili Powder from Mild Bill's
Spice Co. last year. His exact words were " There is no way that stuff was
Gebhardt's-I have been using Gebhardt's for a long, long time and I know what
it is supposed to taste like.  It was a brighter red, and that distinct flavor was
missing." We now have a list of 'disgruntled folks' that were duped by Mild
Bill's and we will be glad to pass along their phone numbers if you want to 
verify their experiences. 

Folks, it is easy enough to verify if you are getting Gebhardt's or not. Spend 
a couple of dollars on the 3 oz bottle, pour both that chili powder and the 'bulk' 
on a white styrofoam plate side by side and put under a bright light-It will be 
very evident they are NOT the same product. Under a microscope of course
it is even more evident they are not the same.  All the 3 oz bottles have a
foil 'seal' under the screw on red cap-make sure the one you get has one
and has not been removed or tampered with.  Just sayin'.......

A Customer Service Rep can give you the UPC Code for any of their products.

A response letter has been sent to Mr. Wilson, the attorney
that did not check some facts before sending me that 'nasty
threat letter'.  We will pay him $100.00 cash money to go to
the walk in cooler at Mild Bill's Spice Co. and write down the
UPC numbers from any box(es) of 'supposed' BULK (50 lb?)
Gebhardt Chili Powder there. After verifying with ConAgra
Foods, the parent company for Gebhardt products, that this
number does exist (don't count on it) we will forward via USPS
Priority Mail a $100.00 bill to Mr. Wilson. If not found, we
would only expect an apology from Mr. Wilson saying he
did not in fact investigate enough before sending that 'nasty 
threat letter'. By the Google aerial map,  Mr. Wilson is just
around the corner from Mild Bill's and should take him all 
of 10 minutes or less.    For $100.00.      CASH MONEY

All ConAgra products have a UPC Code and that is that.
The first set of numbers (44300) is ConAgra's 'master'
number.  Each and every product they manufacture is

We are not alleging that Mild Bill's is selling bulk from 
the 5 lb. containers.  We ARE alleging that Mild Bill's is
selling an inferior product purchased in bulk and selling
it as Gebhardt Chili Powder. By their own admission on
their web site on August 24, 2013 (since removed) they
no longer carry the 5 lb size.  As of this day, September
9, 2013 they continue to advertise that they do carry it
in BULK and it is kept in their climate controlled walk in.
(see caption below) Hence the offer to Attorney Wilson.

American Spice Co. has already verified in writing that
there is no such number on their 50 lb boxes (purchased
from Mild Bill's) and previously when asked Mild Bill's
was not able to forward that 'magic number' to them.

Attorney # 2: Their lips are moving........

We maintain the position that Mild Bill's Spice Co.
of Ennis, TX and American Spice Co. of Ft. Wayne,

and have been for over 1 year. (Former supplies latter)

Update 9/4/2013

Since receiving today a 'nasty threat letter' from an Attorney
hired by Mild Bill's Spice Co., maybe it is time to put a 'timeline'
in place so that anyone interested is better informed......
We welcome a lawsuit to once and for all prove there is 'no 
such item' as Gebhardt Chili Powder in bulk available from 
Mild Bill's Spice Co. see letter here-www.texmex.net/letter.htm

Using the Texas Rules of Evidence, we will immediately file a
Motion with the Court to Request Production on any and all
Receipts and/or Invoices that show Mild Mill's did or did not
purchase 'supposed' 50 lb bulk chili powder. This along with
a Motion to Dismiss as being a frivolous lawsuit that is a waste
of taxpayers money and the legal system resources will be filed.
Any attorney that does not wish to be brought up before the
State Board Grievance Committee would have asked for a 
little more proof before filing such a 'frivolous lawsuit'. Mild
Bill's could have posted on their web site, the now requested
several times, proof of purchase of said 50 lb bulk container
Gebhardt Chili Powder-purchased DIRECT from Conagra Foods
as stated numerous times on their web site in the last 1 1/2 years.

We will consider an action in Federal Court against Mild Bill's, 
as well as entertaining the possibility of a Class Action Suit and/or
countersuit filed as a Class Action suit. We feel many have been
sold a product that was deceptively advertised by Mild Bill's.

Additionally, since the Texas Secretary of State has revoked
Mild Bill's status as an Incorporated entity, both Kelly and Gary
Brignon are no longer protected from liability under the 'corporate
shield' and will be countersued both individually, jointly and severally.

In reviewing a previous statement, we do need to make 2 corrections.

(1) Mild Bill's Spice Co. did not file Bankruptcy in September of 2012.
The owners, listed as Gary and Kelly Brignon, filed personal Chapter
7 and this is listed as a public record. At that time they listed assets
for Mild Bill's of $500.00 and this would contradict the 'amount
of bulk chili powder' they purchased from Conagra Foods and/or
their distributors. The Trustee for their case has been notified.
Any creditor has the right to request from the Trustee for their case
an explanation as to where they have money to start a new legal 
action but cannot pay off some existing debts claimed on their Petition.

(2) Mild Bill's Spice Co. was NOT issued a 'citation' for using
a scale that was not Certified by the State-By the Texas Department
of Agriculture.  I just clarified with the Inspector that they were
issued a copy of the Inspection Findings (which does state they 
were non-compliant) and that in turn was turned over to the Legal
Department at the State for determination of a fine to be assessed.
(Mild Bill's Spice Co. was using a non-compliant scale from 2011-Aug
of 2013)

Conagra Foods Legal Department made aware of Deceptive
Advertising by Mild Bill's Spice Co. and American Spice Co.

Sept.  2012 from Northern District Bankruptcy Court Filing
Gary and Kelly Brignon, owner's of Mild Bill's Spice Co., file
for personal Bankruptcy claiming total assets for Mild Bill's
to be $500.00.  IF they had bought ALL remaining inventory
of Gebhardt Chili Powder as they claim, it would far exceed
the $500.00 they turned in to the Federal Court on the Petition.

Guess it was just an 'oversight' that they now don't
claim that it is Gebhardts in their package with their
label.  Hmmm.....After all, if your Invoice/Receipt says
San Antonio Original, how can you complain that it is
NOT in fact Gebhardts?  Also, FDA requires that all spices
require ingredients be listed, in order of percentage 
used, on each and every label. Just an oversight?
Not to mention Conagra Foods PROHIBITS the repackaging
of their products, specifically Gebhardt Chili Powder.

How about a UPC (bar Code #) on the 'bulk' 50 lb. 'supposed'
chili powder that Conagra Foods has put on that product

Update 8/30/2013

As indicative by the hit counter (hidden) on this web page,
there are obviously a lot of folks interested as to 'who is
right' -we maintain that Mild Bill's is selling a faux Gebhardt
Chili Powder and has been since at least July of 2012.  Mild Bill's
maintains to this very day they are not.......so...the saga continues

Since 3 days have elapsed since our initial Press Release was issued,
Mild Bill's could have resolved this 'difference of facts' by posting
on their web site, an Invoice or Receipt showing they 'did in fact' 
purchase 50 lb 'bulk' Gebhardt Chili Powder direct from Conagra 
Foods (as stated since March 2012 on their web site). At worst they 
could have posted that they are in the 'process' of locating those 
Invoices/Receipts........or submitted to us to post here. No action taken.

So, from my vague memory of a Law School Professor I had some
20 years ago, "When there are 2 sets of opposing facts, concentrate
on one, then the other, and the Truth shall eventually appear."

I am happy with the 1st set of facts-Conagra has never produced
a 50 lb box of Gebhardt Chili Powder for sale to anyone, and
the only size available since February 2012 is the the 3 oz bottle.

Now for the second set of 'facts' that Mild Bill's purports:
1) They bought ALL remaining inventory from Conagra when the
bulk was discontinued in late 2011

2) What they are advertising and selling today is NOT a faux
Gebhardt Chili Powder, but actual Gebhardts that they purchased
in bulk, direct from Conagra Foods, the parent co. of Gebhardt's.

This won't take long to bear out as we are securing a sample of what
Mild Bill's sold to a restaurant along with the Invoice that states it
was 'Gebhardt Chili Powder' 50 lbs. that was purchased from Mild
Bill's in 2012.  That along with a sample from a major spice company
located in Dallas, TX-both samples will be sent to our Certified Food
Scientist, along with an unopened bottle of 3 oz Gebhardt Chili Powder.
We will post the findings here, along with the 'analysis' letter that we
receive from the food laboratory.  

As for Kelly Brignon's statement on the Mild Bill's web site, 

"This can only be viewed as an attempt to damage our reputation
with our customers and we are very saddened by this course of action.


No, we are only seeking the Truth here as many chili cook off participants
spend a lot of hard earned money to attend an event so they may qualify
to attend the World Finals. In Texas, we take our Chili very serious. 
So do a lot of folks around the United States.  Gebhardt's has been 
around 116 years and for someone trying to profit by selling an inferior
product and calling it Gebhardt's is not only morally wrong (Thou shalt
not LIE), it is ILLEGAL in Texas per State Statutes-(Deceptive Trade
Practices Act).

In case no one has noticed-It has been established in writing that American
Spice.com is buying from Mild Bill's in a 50 lb box 'supposed' Gebhardt
Chili Powder.  Check the price for 50 lbs on Mild Bill's ($332.50), then see
the price that American Spice Co is selling it for ($853.37)  !! I have some
ocean front property in Arizona I am interested in selling............for cheap !

While Mild Bill's still maintains they have 'bulk' Gebhardt
Chili Powder in stock, let's examine more than a few facts:

1) American Spice Co. buys the supposed 50 lb box from
    Mild Bills, yet no UPC code is to be found on the box-
    EVERY Conagra product is assigned a UPC code.......
    confirmed in writing by American Spice Co. July 2013
    
2) IF Mild Bill's did in fact buy ALL remaining inventory
    of Gebhardt Chili Powder, why would they list on their
    Bankruptcy Petition filed with the Northern District 
    Court of Texas last September that the assets of Mild 
    Bill's was only $500.00. Hmmmmmm........interesting.
    BTW, to LIE on a Court filed document is considered 
    Perjury.

3) Why would Brian Robertson of Conagra Foods put it 
    in writing that Gebhardt Chili Powder is NOT available
    in Bulk FORM to anyone?

4) Be also aware that Mild Bill's was found on August 8th
    of this year by the Texas Department of Agriculture to 
    be 'non-compliant' by using a scale not certified by the
    State of Texas.  They were given a citation and the Legal
    Department is determining their fine for using a scale
    for the last 3 years that was not 'legal for trade'. Why is
    this worth mentioning? Consistent disregard for the State
    Laws of Texas including the Deceptive Trade Practices Act.

5) Kelly Brignon, of Mild Bill's states that there have been
    no complaints. Well she is wrong.  A restaurant in Virginia
    complained to me that what she was selling "could not be
    Gebhardt's Chili Powder."  "It was a brighter red, and I
    had to adjust my recipes" states the 3rd generation owner
    of a restaurant that has been using Gebhardt Chili Powder for
    over 80 years until discontinued last year.

6) If Mild Bill's did in fact buy all 'remaining stock' BEFORE
     it was discontinued, why would my phone records show they
     called me in Spring of 2012 wanting to buy some of mine?
     The last batch of 5 lb Gebhardt Chili Powder was produced
     in late 2011-SYSCO was out in February of 2012...........

7) Conagra Foods has NEVER sold a 50 lb box of 'bulk'
    Gebhardt Chili Powder to anyone-the largest was the 5 lb
    containers and there were 4 to a case...........

8) For over a year Mild Bill's stated on their web site that they
    had no problem meeting the minimum buying requirements
    from Conagra Foods, yet all of a sudden (today) they are
    buying from 'their (Conagra's) network of distributors and 
    wholesalers'. Geez, which is it please..........


If in fact Mild Bill's has 50 lb boxes of Gebhardt Chili Powder,
they should post a copy of the Receipt from Conagra-which is
where Mild Bill's supposedly buys direct.........of course they
can 'black out' the pricing-Show us the Invoice or Receipt.

Conagra Foods on Wednesday, July 24th, 2013 CONFIRMED that Gebhardt Chili Powder
is available only in a 3 oz Retail size.  All companies claiming they buy in bulk’ direct from
Conagra and repackage this Chili Powder are simply deceiving the consumer.  In February
of 2012, the then available 5 lb containers of the ‘best chili powder’ in the World started
becoming unavailable through brokers and wholesale companies.  It was deleted from the
Conagra inventory and there has been none produced in a ‘bulk container’ since.

Two online Internet companies have been advertising and selling ‘repackaged’ bulk quantities
to consumers.  Mild Bill’s Spice Co. of Ennis, TX (www.mildbills.com ) and The Great American
Spice Co.
(www.americanspice.com) of Ft. Wayne, IN both advertise on their web sites that they
buy direct from Conagra. This is simply not true as Bulk quantity is not available to ANY outside 
source.

A formal complaint has been filed with both the Attorney General of Texas under the Deceptive
Trade Practices Act (DTPA) and the FBI Internet Fraud Dept.  An investigation is currently
underway for both companies.  Additionally the Legal Department at Conagra Foods is aware
of the ‘substitute’ Chili Powder being sold under the name of Gebhardt and is taking steps to
correct the false advertising.

If you purchased Gebhardt Chili Powder from either of these 2 companies in 2012 or 2013 in
a size other than the 3 oz bottle you are entitled to, but not limited to:

1) Ask for a refund from the respective company you purchased it from, and
